Warranty: M&Q Packaging Corporation ("M&Q") warrants to each consumer ("Consumer") of PanSaver and ScrubSaver plastic film lining products (the "Products") that, if used in accordance with all current instructions and specifications developed by M&Q and made available to Consumer (the "Specifications"), the Products will perform substantially in accordance with the Specifications; provided, however, that such warranty shall not apply: (i) if the Products have been modified, changed or altered; (ii) if the failure to perform substantially in accordance with the Specification is caused by Consumer, its agents or employees, or (iii) if Consumer fails to promptly notify M&Q, in writing, of such failure after it is discovered. If, within 90 days after the date of original purchase, Consumer notifies M&Q, in writing, that the Products purchased by Consumer have not performed substantially in accordance with the Specifications, and Consumer returns the non-performing Products to M&Q, postage prepaid, M&Q shall, at no additional charge to Consumer, and as Consumer's sole and exclusive remedy, replace the non-performing Products.
